Government strengthens protection of natural areas and indigenous peoples from road infrastructure works

The Executive Branch approved Supreme Decree N°005-2018-MTC which “.“Establishes Provisions Applicable to Road Infrastructure Projects and for the Updating and/or Modification of the Route Classifier of the National Highway System - SINAC.”The objective of the project is to articulate the criteria that regulate the protection of natural protected areas (NPAs) and indigenous peoples in isolation and in initial contact with the development of infrastructure projects and road hierarchization.

The regulation is the result of consensus work developed by the Ministry of the Environment (MINAM); the National Service of Natural Areas Protected by the State (SERNANP), an agency attached to MINAM; the Ministry of Culture (MINCUL) and the Ministry of Transportation and Communications (MTC).

It is established that road infrastructure projects under the responsibility of the National Government, through the Ministry of Transportation and Communications; Regional Governments and Local Governments, must ensure compliance with environmental regulations, protected natural areas, and those that guarantee the protection of indigenous or native peoples in isolation and in a situation of initial contact.

Likewise, it is required to update and/or modify the Classifier of Routes of the National Highway System under the responsibility of the Ministry of Transportation and Communications, in order to exclude those routes or projected road infrastructure sections that overlap with protected natural areas, indigenous and territorial reserves or buffer zones that do not have the compatibility of SERNANP.

It should be noted that the Road Classifier is the official document of the National Highway System that compiles the existing roads in the country, classifying them into national road networks, departmental or regional road networks and neighborhood or rural road networks, depending on whether they interconnect various regions of the country, only regions or only local communities.

Therefore, the MTC will ensure that only new road projects or sections that do not overlap with:

  1. Natural Protected Areas of indirect use.
  2. Territorial or Indigenous Reserves.

In the case of Natural Protected Areas of direct use and Buffer Zones, it will only be included when the proposal has been approved by SERNANP.

In addition, the regulation aims to achieve the interoperability of the databases of the geographic information systems of MINAM, MINCUL and MTC, so that these entities have online cadastre information.
